Text, graphics, colours, page headers, banners, scripts, service names, product names, logos, icons, images, video clips, audio clips, music, forms, interactive features, digital downloads, data compilations, and software included in or made available through the Santa Pics App are trademarks, trade dress or word marks and/or otherwise intellectual property of First Descent Software Ltd. or its affiliates (“First Descent”). First Descent trademarks, trade dress, word marks and intellectual property may not be used in connection with any product or service that does not belong to First Descent or its affiliates, or in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits First Descent or its affiliates or the Santa Pics App.
All other trademarks not owned by First Descent or its affiliates that appear in the Santa Pics App are the property of their respective owners, who may or may not be affiliated with, connected to, First Descent or its affiliates.
One or more patents owned by First Descent may apply to the Santa Pics App and to the features and services accessible in it. Portions of the App may operate under license of one or more patents.
First Descent will respond to valid notices of intellectual property infringement and reserves the right to terminate access, at is sole discretion, to the App of any users who repeatedly infringe intellectual property rights.
If you believe any content posted or made available on the Santa Pics App constitutes infringement of your intellectual property rights, you may send a written notice of infringement to First Descent. In your notice, please specify the nature of the infringement and include the following information: (a) an electronic or physical signature of the owner in question or a person authorized to act on behalf of the owner; (b) a description of the claimed infringing material as well as identification of the claimed infringing material, including the location of such material on the Santa Pics App; (c) complete contact information, including the name of the owner and your name, title, address, telephone number, and email address; (d) a statement that you have a good faith belief that the disputed use is not authorized by the owner, its agent, or the law; (e) a statement that the information provided in your notice is accurate and that you are the owner or authorized to act on behalf of the owner; and (f) your trademark registration number(s), if applicable.
