Please be mindful and consider others when using the Santa Pics App. The social and interactive features of the Santa Pics App, including the ability to post and share content, may make certain information about you public. Be aware of your account settings and what you’re posting or sharing. First Descent Software Ltd. has no responsibility for your choices to post material on the Santa Pics App or any other platform.
Please respect your fellow users of the Santa Pics App. Don’t do or post anything that:
- is offensive, abusive, hateful, racist, sexist, defamatory, pornographic, threatening or obscene;
- is illegal, or intended to promote or commit an illegal act of any kind, or violate the privacy rights, or proprietary rights of First Descent, an App user or a third party;
- discloses your password or anyone else’s password or purposely shares personal data of someone else;
- contains malicious content or software such as malware, Trojan horses, or viruses, or interferes with any user’s access to the Santa Pics App or causes them harm;
- is intended to or does harass or bully others;
- impersonates or misrepresents your affiliation with another user, person, or entity, or is otherwise fraudulent, false, deceptive, or misleading;
- sends unsolicited mass mailings or messages or other forms of spam (“spam”), junk mail, chain letters to others;
- involves advertisements, promotions, contests, sweepstakes, or pyramid schemes, that are not expressly authorized by First Descent;
- links to, references, or promotes commercial products or services, except as expressly authorized by First Descent;
- interferes with or disrupts the Santa Pics App; or
- conflicts with the Agreement you have with First Descent.
We may, at our discretion, monitor, review, or edit User-Generated Content. We will not tolerate hateful comments, discriminatory language, threats or violence of any kind. We reserve the right to remove or disable access to any User-Generated Content for any or no reason and without prior notification to you or any third party. If you see this type of content, we want you to tell us so we can act on it.
You retain all rights to your own User-Generated Content. We won’t be publishing it or using it in our marketing or turning it into a testimonial without your permission. But because you retain that right, you are solely responsible for your content. You promise that: a) you own it or have the right or permission to post it, and (2) it does not violate this Agreement or any other rights set forth within any applicable law, nor does it violate the rights of others. So, don’t share or post things that don’t belong to you and be prepared to be accountable for what you do post.
If you post User-Generated Content, you agree that we can display it on the Santa Pics App or Santa Pics website or other media channels world-wide and royalty free in perpetuity.
